These Terms of Service (the "Terms") govern your access to and use of the DaVinciGraph platform, and any services, features, content, or applications offered on or through the platform (collectively, the "Services").

The Services are intended solely for users who are 18 years of age or older. Any access to or use of the Services by anyone under 18 is strictly prohibited. By accessing or using the Services, you represent and warrant that you are 18 or older.
In order to access certain features of the Services, you may be required to register for an account by connecting your web3 wallet to the platform. During the registration process, you may be required to provide certain personal information about yourself, including your name and email address. You agree to provide accurate, current, and complete information about yourself when creating an account, and to update such information as necessary to maintain its accuracy. Your web3 wallet serves as your login credentials and is used to access your account. You are responsible for protecting your web3 wallet and any digital assets stored within it. You are also responsible for maintaining the confidentiality of your account login information and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account or any other breach of security. We will not be liable for any loss or damage arising from your failure to comply with this security obligation.
The Services and all materials contained on the Services, including but not limited to text, graphics, images, software, and the HTML used to generate the pages (collectively, the "Content"), are the property of DaVinciGraph or our licensors and are protected by copyright and trademark laws. You may not use any Content for any commercial purpose or for any public display without the prior written permission of DaVinciGraph.
The trademarks, service marks, and logos of DaVinciGraph (the"DaVinciGraph Trademarks") used and displayed on the Services are registered and unregistered trademarks or service marks of DaVinciGraph. Other company, product, and service names located on the services may be trademarks or service marks owned by third parties (the "Third-Party Trademarks", and, collectively with the DaVinciGraph Trademarks, the "Trademarks"). The display of Trademarks on the Services does not imply that a license of any kind has been granted.
The Services may allow you to purchase DaVinciGraph Utility NFTs or DAVNCI Tokens from us. All purchases are final and non-refundable. We reserve the right to change the price of any DaVinciGraph Utility NFTs or DAVINCI Token at any time without prior notice.
It is important to note that investing in digital assets, including DaVinciGraph Utility NFTs and DAVINCI Tokens, carries inherent risks. These risks may include, but are not limited to, market fluctuations, technical failures, and regulatory uncertainties. DaVinciGraph does not provide investment advice and cannot guarantee the performance or success of any digital asset. You are solely responsible for your own investment decisions and should carefully consider your own financial situation before making any purchases on the platform.
You agree to pay all fees and applicable taxes incurred by you or anyone using your account. If your payment method fails or your account is past due, we may collect fees owed using other collection mechanisms. By using the Services to purchase DaVinciGraph Utility NFTs or DAVINCI Tokens, you acknowledge and agree that you are fully aware of the risks associated with investing in digital assets and accept full responsibility for any losses or damages that may result from your purchases. DaVinciGraph will not be held responsible for any losses or damages incurred as a result of your purchases on the platform.
In addition to DaVinciGraph Utility NFTs and DAVINCI Tokens, our Services feature a Launchpad that allows users to initiate and support token projects on the Hedera network. The Launchpad facilitates the creation and promotion of new tokens, providing a platform for users to participate in innovative ventures. However, users engaging with the Launchpad should be aware that investing in token projects carries risks, including market fluctuations and project uncertainties. DaVinciGraph does not provide investment advice, and the success of any token project is not guaranteed. Users are encouraged to conduct thorough research and assess their own risk tolerance before participating in Launchpad activities.
The Services may contain links to third-party websites or services that are not owned or controlled by DaVinciGraph (the"Third-Party Services"). We have no control over, and assume no responsibility for, the content, privacy policies, or practices of any Third-Party Services. We do not endorse and will not be liable for any Third-Party Services or for any loss or damage that may arise from your use of them. You are solely responsible for your use of any Third-Party Services and for compliance with any terms and conditions that may apply to your use of them.

TO THE FULLEST EXTENT PERMITTED BY LAW, DaVinciGraph DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. DaVinciGraph DOES NOT WARRANT THAT THE SERVICES OR ANY CONTENT OR MATERIALS WILL BE UNINTERRUPTED OR ERROR-FREE, AND WILL NOT BE LIABLE FOR ANY INTERRUPTIONS OR ERRORS.
IN NO EVENT WILL DaVinciGraph, ITS AFFILIATES, OR THEIR LICENSORS, SERVICE PROVIDERS, EMPLOYEES, AGENTS, OFFICERS, OR DIRECTORS BE LIABLE FOR DAMAGES OF ANY KIND, UNDER ANY LEGAL THEORY, ARISING OUT OF OR IN CONNECTION WITH YOUR USE, OR INABILITY TO USE, THE SERVICES, ANY WEBSITES LINKED TO THE SERVICES, ANY CONTENT ON THE SERVICES OR SUCH OTHER WEBSITES, INCLUDING ANY DIRECT, INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO, PERSONAL INJURY, PAIN AND SUFFERING, EMOTIONAL DISTRESS, LOSS OF REVENUE, LOSS OF PROFITS, LOSS OF BUSINESS OR ANTICIPATED SAVINGS, LOSS OF USE, LOSS OF GOODWILL, LOSS OF DATA, AND WHETHER CAUSED BY TORT (INCLUDING NEGLIGENCE), BREACH OF CONTRACT, OR OTHERWISE, EVEN IF FORESEEABLE.
You agree to defend, indemnify, and hold harmless DaVinciGraph,its affiliates, and their licensors, service providers, employees, agents, officers, and directors from and against any and all claims, damages, obligations, losses, liabilities, costs, or debt, and expenses (including but not limited to attorney's fees) arising from: (i) your use of and access to the Services; (ii) your violation of any term of these Terms; (iii) your violation of any third-party right, including without limitation any copyright, property, or privacy right; or (iv) any claim that your User Content caused damage to a third party. This defense and indemnification obligation will survive these Terms and your use of the Services.
DaVinciGraph and its agents will not participate in any legal proceedings and cannot be sued in connection with the Services or these Terms. Any legal action or proceeding arising from or related to the Services or these Terms must be brought against the individual user and not against DaVinciGraph or its agents.
